Zoning Board of Appeals Function

The Zoning Board of Appeals has the exclusive subject matter for dimensional variances, use variances, special exceptions, and administrative appeals. The Board is authorized to grant relief from any provision of the Town of Mohawk Zoning Ordinance or any decision of an administrativce official charged with the enforcement of that ordinance.

Further, the Board is empowered to grant special use permits as described in the Town's Zoning Ordinance. Town Law specifies the grounds and criteria that the Zoning Board of Appeals must use to grant such variances.

The Zoning Board of Appeals consists of five (5) members appointed by the Town Board, each for a term of seven (7) years on a staggered basis.

Applications for variances can be downloaded or obtained from the Town of Mohawk's Clerk's Office at 2-4 Park Street, Fonda, NY 12068. Board hearings are held by appointment only, usually on the third Thursday of each month at 7:00 pm at the Town Hall at 2-4 Park Street, Fonda, NY 12068. These hearings are open to the public for comment and past decisions can be reviewed at the Town of Mohawk's Clerk's Office.
